Terms of Service

These Terms of Service ("Terms") govern access to and use of the Paver Portal platform, websites, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the company you represent ("Customer").

1. The Service

Paver Portal is a software platform that helps hardscaping companies create, publish, and manage project proposals and communicate with their clients. The Service is provided on a subscription basis.

2. Accounts & workspaces

Each Customer operates within its own workspace. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your accounts, including accounts you create for your staff and clients.

3. Subscriptions, trials & billing

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Trials convert to paid subscriptions automatically at the end of the trial period unless canceled before it ends. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice; changes take effect at your next billing cycle. If payment fails, we may suspend the workspace until billing is resolved; Customer Content is retained during suspension as described below.

4. Customer Content

"Customer Content" means the data you and your users submit to the Service — clients, proposals, messages, photos, notes, and documents. You own your Customer Content. You grant us a limited license to host, process, transmit, and display it solely to provide and improve the Service. You represent that you have the rights and permissions necessary to submit Customer Content, including any personal information about your clients.

The Service includes informational tools (including AI-assisted features) that may reference construction practices, standards, or building-code information. This information is provided for convenience only and may be incomplete, outdated, or inapplicable to a specific project or jurisdiction. It is not engineering, legal, or code-compliance advice. Customer is solely responsible for verifying requirements with the applicable authorities and for the accuracy of proposals, contracts, and work delivered to its clients.

7. Intellectual property

We own the Service, including its software, design, and branding. These Terms grant no rights to our intellectual property except the limited right to use the Service during your subscription.

8. Termination

You may cancel at any time, effective at the end of the current billing period. We may suspend or terminate access for material breach of these Terms or non-payment. For 30 days following termination, we will make Customer Content available for export on request, after which it may be permanently deleted.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our aggregate liability arising out of or relating to the Service is limited to the amounts paid by Customer in the twelve (12) months preceding the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in California.
